TERMS AND CONDITIONS
In organizing a day-long touristic excursion by boat m/b Stupica
I GENERAL REGULATIONS
Article 1.
The relation between the Carrier and the business partner, the passenger, are regulated by this general regulations and in addition speak about the principles that are obligatory when making a reservation, therefore when using the service provided by m/b Stupica. Business partner, the passengers are obligatory to tone their behavior with the general regulations.
Article 2.
The Carrier in their propriety has a ship m/b Stupica and with it organizes a day-long excursions in Rovinj’s archipelago.
Article 3.
In times of need, the Carrier has the right to rent another ship with similar characteristic and is obliged to execute the agreed upon service.
II RESERVATION
Article 4.
Questions and reservation of a day-long excursion by ship m/b Stupica is acquired electronically by mail, by phone or personally in the office of the Carrier. For reservation it is necessary to make an advance payment and the business partner, the passenger, bears the coast for such payment. After the payment, the Carrier sends the voucher to the passenger and it is used as a confirmation for reservation and it must be given when checking in. The received deposit is calculated as a share of complete amount which is later diminished by the advance payment. The other share of the excursion is paid on the day you made the reservation.
III WAY OF PAYMENT
Article 5.
M/b Stupica offers the possibility of cash payment and transaction payment by bank account.
IV ARRIVAL OF THE PASSENGER
Article 6.
The passenger is obligatory to come to the agreed place of meet-up, 15 (fifteen) minutes before the beginning of the excursion.
V PASSENGER OBLIGATIONS
Article 7.
The passenger is obligatory:
- observe the rules and the way we behave a board the ship and work in correlation for mutual satisfaction
- at the agreed place of meet-up arrive 15 minutes earlier
- upon arrival , present the document ( voucher) with payment confirmation
- pay the rest of the amount ( in correlation with the agent) at sight to the agent or the ship commander
- be responsible for damage and behavior aboard the ship
VI CARRIER OBLIGATIONS
Article 8.
The Carrier is obligatory to provide all of the necessary information to the passenger which includes:
- estimated time of ships departure and arrival
- itinerary of the excursion
- change of the itinerary
- time delay of the ship
VII DAMAGE
Article 9.
The passenger is obligatory to take care about their belongings and bear the responsibility for possible theft, loss or damage of the item left without supervision
Article 10.
M/b Stupica does not answer for the damaged, ruined and lost baggage, as for theft of belongings
Article 11.
The passenger bears the responsibility for the damage made on the Carrier’s propriety.
VIII REALIZATION OF THE TRIP
Article 12.
The minimal amount of the passengers for the trip to take the place is twenty (20). If the minimal amount of the passengers is not registered, the excursion is being cancelled, and the passengers are being returned their money in the form of the advanced payment.
IX CANCELING THE EXCURSION BY THE PASSENGER
Article 13.
In case of canceling the already paid excursion/deposit, the money is returned in case of death or disease with medical confirmation.
Article 14.
Regulation from article 13. Does not apply if the Carrier and the passenger made the other agreement upon canceling the excursion and the services.
X CANCELING THE EXCURSION BY THE M/B STUPICA
Article 15. Paragraph 1.
M/b Stupica has the right to cancel the excursion in any given moment with the written notice to the passenger if the canceling was affected by the ‘higher force’ ,the circumstances which m/b Stupica could not affect or foresee, control or avoid , even if m/b Stupica acted with attention in the accordance with good management.
Article 15. Paragraph 2.
The ‘higher force’ in marine transportation is referred to any unpredictable event completely out of control of the Carrier ,including weather disaster ( heavy rain ,strong wind, flood ,earthquake, storm, hurricane or other natural disasters) ,war, invasion ,unfriendly actions (even if it is a non declared war) ,civil war ,riots, revolutions ,confiscation ,terroristic attacks ,industrial sabotage, natural or industrial catastrophe, fire, epidemic ,health risk ,nationalization, government sanctions, embargo, blockade, failure or cut in power , undisturbed operation of telecommunication services and any other unpredictable technical issue regarding the transport (failure of ships engine).
Article 15. Paragraph 3.
If any circumstances given in article 15. Paragraph 2. occur, the Carrier must without the delay notice every passenger that the excursion will not take place and if the excursion has already started ,take the passengers to the nearby docking point.
Article 15. Paragraph 4.
Even when the Carrier has doubts about the potentially dangerous situation that could be life threatening or endanger the health and the personal propriety of the passenger, the Carrier has an exclusive right to cancel the excursion (even if it has already began) and then take the passengers to the nearby docking point.
Article 15. Paragraph 5.
M/b Stupica will provide a choice to the passenger for the following:
- to receive a full payment
- to make a reservation for another day as soon as the ‘higher force’ is eliminated
- if it is possible ,to take another ship that is not in the propriety of the Carrie with similar characteristics and offering the same service
XI BE INFORMED
Article 16.
All of the business partners/ the passengers are obligatory to read the terms and conditions as well as the general resolutions. By confirming the reservation and paying in advance, the full amount of the reservation, they are confirming all of the terms and conditions listed above.
XII COMPLAINTS
Article 17.
Every business partner/ the passenger has a right to complaint for the services m/b Stupica provides. Written reclamation can be delivered to: GIORGIO PRIVILEGGIO PASCIA 9, 52210 ROVINJ; as well as electronically (mail) to helena.radic7@gmail.com
The Carrier must deliver the written solution at any complaints within 15 days.
XIII TRANSITIONAL AND FOLLOWING REGULATIONS
Article 18.
Eventual litigation that could come out of business relation between the Carrier and the passenger can be resolved agreeably, if not the issue is passed down to the Commercial Court in Rijeka
